Additional Proposals

Preamble

Section A. This supplemental is entered into by the Federal Correctional Complex, Coleman Florida,  to include the Medium Facility, Low Facility, Camp and any other facility which may be built at a later date, herein after referred to as "Employer" and the American Federation of Government Employee's/Council of Prison Locals, Local #506, Coleman Florida,  herein after referred to as the "Union."

Section B. In accordance with the provisions of the Master Agreement between the Federal Correctional Complex and the Federation of Government Employee's/Council of Prison Locals, this agreement shall be a supplement to the said Master Agreement.  This agreement will not exceed the life of the Master Agreement which is March 8, 2001.


Article 1
Recognition

Section A.  The Union is recognized as the sole and exclusive representative for all bargaining unit employees as defined in the Master Agreement.  As such the Union is entitled to act for and negotiate agreements concerning all employee's in the bargaining unit.

Section B. The Union President or expressed designee will be the designated contact person whenever the Union is identified in this supplemental agreement, unless specified otherwise and in writing.
 
 


Article 2
Joint Labor Management Relations Meetings

Section A.    The purpose of a "Labor Management Relations Meeting" (LMR) will be to discuss issues and concerns as well as perceptions and seek out resolutions with respect to personnel policies, practices and matters affecting working conditions and employee moral at the Federal Correctional Complex, Coleman Florida.

Section B. The Union and Employer will exchange agenda items in writing not less than five (5) working days prior to the meeting.  In order to allow both parties to adequately prepare for these meetings, the agenda items will include specific details of issues to be discussed.  Although the exchanged agenda items are not considered inclusive, it is understood new proposals introduced at the monthly meeting may result in that item being tabled.  Meetings may only be canceled by the consent of both parties.

Section C. Either party may call an unscheduled LMR meeting when issues of immediate concern arise, to normally occur within 48 hours.

Section: D Representatives for the Union and the Employer who are in attendance at the LMR meeting must be empowered to make decisions concerning any topics raised which are within their authority.

Section E. The Employer will prepare minutes to the items discussed, agreements reached and/or suspense dates set for follow-up action.  The minutes will be reviewed and approved by the parties upon conclusion of discussion of each issue.  A final formalized copy of the minutes will be reviewed and approved by both Chairpersons within five (5) working days.

Article 6

Section A. Prior to an employee's request to speak with a representative of the Union being perceived as abuse, the employer must provide written notification and reason of said abuse to the employee and the Union.

Section B. The Union will be afforded a 30 minute time slot in both Annual Refresher Training and Institution Familiarization to address the employee's at FCC Coleman.  This time will be utilized to advise employee's as to their rights under the Master Agreement, Local Supplement and 5 U.S.C., as well as other relative information.  The Employer will be afforded the opportunity to review any lesson plans used during the aforementioned.


Article 7
Rights of the Union

Section A. In the absence of the Union President, the following Union officials, in order, will be delegated his/her authority: Executive Vice President, Vice Presidents, Chief Steward, Treasurer, Secretary.

Section B. Stewards shall be vested with sufficient authority to resolve disputes at the informal step.  Final decisions of any formal resolution shall be the responsibility of an executive officer of the Union, in the absence of the Union President.

Section C. The Union may request a designated Union representative be given Annual Leave to attend funeral or memorial services for members of the bargaining unit or an immediate family member of the bargaining unit employee.  Immediate family member is defined, for this section, in the Master Agreement under Article 19, Section D.

Section D. The work schedule for the Union President and one other designated Union official per facility, either stewards or Executive Board members only, will be Monday thru Friday, during the day time hours of 6:00 am to 6:00 pm, in accordance with Section F, Rotation Policy.

Section E. The Union will be given an opportunity to be placed on the recall agenda to address staff at general staff recalls for the purpose of making announcements of upcoming events/activities, however, not to conduct union business.

Section A. The Union will be allowed membership on promotion boards as observers to ensure that all procedures have been properly adhered to and followed as well as to confirm the integrity of the selection process for bargaining unit positions.

Article 12
Use of Official Facilities

Section A. The Employer will provide and install a locking bulletin board for the exclusive use of the Union in the following areas:

1.    Staff Lounges at the Low, Medium, U.S.P. and C.A.B.
2.    A location to be mutually agreed upon for the Camp.

Section B. The Employer will provide an easel for each institution for the exclusive use of the Union during the week of Union meetings and/or special events.

Section C. The Employer will provide a locking “drop box” in each staff lounge  for the purpose of providing employees a secure location to deposit suggestions and other forms of communications to the Union.

Section D. The Employer will designate two parking spaces next to the Employee of the Month & Supervisor of the Quarter for Union officials at the Low, Medium and U.S.P., staff parking areas.

Section E. To better serve the membership and considering the size of the local, the Employer will furnish the Union with an additional standard office space as well as the existing Union office space, both of which are at the C.A.B.

Section F. The Employer will equip the Union Office with the following:

 1.   One (1) commercial telephone line into the Union Office.  An additional telephone line for Internet access only may be installed at the expense of and billed to the Union.

2. One (1) computer and laser printer with LAN System capabilities as well as Internet access capabilities.

 3.   One (1) color TV/VCR

 4.   All standard office furniture to include desks, tables, chairs, stands, and shelves.

Article 16
Position Description and Review

Section A.     Employee's will have access to any Position Description that they request.  A copy of the requested Position Description will be provided to the employee upon request.
 
 


Article 18
Hours of Work

Section A.    All bargaining unit employees will be afforded the opportunity to request shift and post assignments within their respective department as outlined in section D of the Master Agreement, unless mutually waived.

Section B.    Ordinarily, employees will be provided sufficient time to complete official reports during their scheduled duty hours.  However, if duties warrant work which might exceed the normal duty hours, the employee should notify his/her supervisor requesting relief or overtime to complete work.  Employees will be eligible for overtime or compensation time in the event he/she is required to remain after their scheduled duty hours.  Employees working two (2) hours in excess of their regular scheduled duty hours will be given the opportunity to:

1. Make a phone call to notify a family member that he/she is working overtime.

2. Acquire a meal or snacks. The employee may have a meal delivered to the institution to be delivered to the employee.

Section C. Employees may request to have a holiday off or work a holiday.

Section D. Each Institution will maintain their own Correctional Services overtime roster.  Management will attempt to afford overtime to personnel at their respective institution prior to utilizing resources at the other institutions.  This will be accomplished in accordance with set procedures.
 
 


Article 19
Annual Leave

Section A. Annual leave will be assigned by a three round system.  The employee will have a choice between requesting consecutive or split weeks.  If split weeks are chosen, the two split weeks will be considered as one choice.  These provisions will be used in compliance with Article 19 of the Master Agreement, unless mutually agreed upon by Department Head and Union.

Health and Safety

Section A. Any employee who is soiled by body fluids or body wastes or is soiled sufficiently enough to cause discomfort to a reasonable person shall be relieved from duty as soon as possible in order to bathe and change clothes prior to resuming their duties.  Employees who fall into this category shall be in a paid duty status while they are changing their clothing and bathing and must return to duty within a reasonable period of time.
 
 


Article 28
Uniform Clothing

Section A. The Employer agrees to provide each employee $90.00 for the purchase of work shoes, to be provided within accordance of Article 28, Section A.   Shoes will be ordered through catalogs provided by management and/or management will request a vendor truck to bring samples to the institution quarterly for employees to purchase.

Section B. The Employer will purchase and provide the following foul weather gear to employees upon request in accordance with Article 28.  Sufficient foul weather gear will be available for daily chitting out.

  1. Yellow raincoat ( with bills ) and pants

  2. Rubber boots ( all sizes )

 3. Coveralls ( will be available for the  rear gate use only when unscheduled staff member who ordinarily does
 not wear nickel gray) is assigned to rear gate.

  4. Ball caps

  5. Wind breakers with lining ( all sizes)

Section C. The Employer will ensure radio cases for all radios are available due to the fact that the radio clips currently in use do not provide adequate security support for the radio in an emergency situation.

Section D. The Employer will provide protective clothing to the SHU officers when serving the meals and to the Compound officers when filling the mowers with gasoline.

Section E. Food Service Department staff will be issued a butcher type coat (white smock) to protect their uniforms from the daily wear and tear associated with that particular department.
 
 


Article 29
Work Site Conditions

Section A. The Employer agrees to install numerical signs to identify zones around the perimeter fence.

Section B.      The Employer, to the extent possible, agrees that no staff member shall have to share an office with an inmate.

Section C. Management shall place two computers with LAN access in a Housing Unit at the medium security facility of the Union’s choice.  Management shall also provide all unit officers with access to a typewriter in their work areas comparable to those provided to Unit Secretaries.  The placement of these computers is on a trial basis.

Section D. The Employer agrees that all staff will have access to a copier on all shifts.

Section E. The Employer agrees that all staff lounges will be maintained for the purpose they were designed, for the life of this agreement, unless a mutual agreement is reached.

Section F. The Employer agrees, to the extent possible,  an EZ Go will be maintained for use by the compound officers.  In the event the EZ Go is not available, a cart will be made available for transporting property, hot trash, etc.

Section G. The Employer agrees to equip the compound office at the Low, Medium and Penitentiary with at least the following:
  1). A computer with LAN access
  2).  A printer
  3).  A typewriter (comparable to secretaries)
  4).  A telephone

Section H. Management agrees to provide a suitable cover for staff to exchange weapons while on perimeter post.

Section I. The Employer agrees that all towers used at this time or in the future will be built to code and  equipped with, at least, the following:
  1). A refrigerator.
  2). A microwave oven.
  3). A phone.
  4). An intercom allowing speech to each other,  as well as Control.

Observation posts will not ordinarily be used as a permanent assignment.  In the event it is deemed necessary to become a permanent post for a protracted period of time, the work site conditions will be improved in accordance with Article 29, Section C, Subsection 5.

Section J.    The Employer agrees that all staff mailboxes that are located in areas that have any inmate access will be secured.

Disciplinary and Adverse Action

Section A. Management will not act in an arbitrary or capricious manner when assigning staff from a shift or a quarterly post assignment.  This is in accordance with Article 30.

Section A. The Local Supplemental Agreement will be printed and distributed in accordance with Article 41.


Article 42
Effective Date and Duration of this Agreement

Section A. This agreement will take effect in accordance with Article 9 and Article 42 of the Master Agreement.
 
 


ADDITIONAL PROPOSALS

Any warrant, subpoena, or other civil papers which specifically states that it must be served at the employee’s work site, will be served at the Central Administration Building in a discreet manner.  This will serve to protect the privacy of all employees.

Management agrees that employees will not be held responsible for behavior or actions of others which adversely affect FCC Coleman, which is not encouraged  by the employee or in conflict with the Standards of Conduct and Employee Responsibility.

The Employer will provide jumper cables for use by staff members.  These will be stored in the Control Center at the Low, the Medium and the Penitentiary.

The Union will be able to review water safety tests conducted on
institution water.

Management agrees that all chairs provided for use by staff will be maintained properly to include cleaning, repair or replacement when necessary.

Management agrees to provide copies of the Local Union Supplemental Agreement to all employees.
